Incarcerated Debtor who Lacked Regular Stable and Regular Income was Not Eligible to file Chapter 13 under §109(e)

An incarcerated Debtor with monthly income of $64.28 and monthly expenses of $112.88 proposed a Chapter 13 plan in which he would pay creditors $25 per month over 60 months.

The plan states that Debtor’s attorney’s fee will be $5,000.00, which was already paid.
