 The issue before the Court is whether the equitable doctrine of laches bars creditor’s motion to dismiss Debtor’s chapter 7 bankruptcy case under 11 U.S.C. § 707(a).

The creditor who filed the motion to dismiss the case waited 13 months to file the motion.
