Attorney’s Failure to Conduct Reasonable Investigation of Debtor’s Income & Expenses Led to Dismissal of Case & Sanctions against Lawyer

Chapter 7 Trustee filed a motion dismiss the debtor’s bankruptcy case as an abuse of the provisions of chapter 7 based upon the “totality of the circumstances” under § 707(b)(3)(B) and requested that the Court order debtor’s counsel to reimburse the Trustee for costs, including attorney’s fees, in prosecuting the Motion pursuant to § 707(b)(4).
